1The Tribunal issued a Case Assessment Direction on June 18, 2012, directing the respondents and two of the applicants, Marina Biazrov and Ragani Shiwrat, to provide submissions if they objected to the Tribunal’s proposal to consolidate the Applications of Ms. Biazrov and Ms. Shiwrat (2011-10477-I and 2011-09990-I) for the purposes of hearing them together. Neither of those applicants, nor the respondents provided any submissions objecting to the consolidation, and the Applications of Ms. Biazrov and Ms. Shiwrat have therefore been consolidated so that they will be heard together.
2A hearing has not yet been scheduled, but a three day hearing has been scheduled for the Application of Mr. Fawzy, commencing February 11, 2013. Mr. Fawzy’s Application is filed against the same corporate respondent alleging reprisal in employment. The facts and issues appear to be significantly interrelated with the facts and issues in the Applications of Ms. Biazrov and Ms. Shiwrat.
3It would appear that the appropriate course of action is to hear the three matters at the same time.
4Under Rule 1.7(d) of the Tribunal’s Rules of Procedure, the Tribunal has the authority to consolidate or hear applications together. The parties are directed to notify the Tribunal within two weeks of this Interim Decision if they have any objection to consolidating and hearing Ms. Biazrov and Ms. Shiwrat’s Applications together with Mr. Fawzy’s Application on the dates of February 11-13, 2013, and, if so, to provide any submissions in support of their position. If no submissions are received opposing the proposed hearing of these matters together, they will be consolidated and heard together. If there are objections the Tribunal will consider any submissions and may provide further directions or determine the consolidation issue.
