1These three Applications allege discrimination in housing on the basis of race, colour, and disability. The Applications pertain to the same alleged events and the applicants are family members. As one of the individuals on whose behalf an Application has been brought is a minor, in accordance with Rule 3.11.1 of the Tribunal’s Rules of Procedure, the applicants’ names have been anonymized (see Interim Decision 2011 HRTO 2003).
2The first Application (2011-9963-I) was filed by S.R. pursuant to section 34(1) of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The second Application (2011-10171-I) was filed by S.R. pursuant to section 34(5) of the Code on behalf of A.F. The third application (2011-10170-I) was filed by S.R. pursuant to section 34(1) of the Code on behalf of E.R. who is a dependent minor of S.R. and A.F. All three Applications allege that when the applicants requested assistance to enter to the pool area, a representative of the respondent responded with discriminatory comments.
3Rule 1.7(d) of the Tribunal’s Rules of Procedure states that, in order to provide for the fair, just and expeditious resolution of any matter before it, the Tribunal may consolidate or hear applications together.
4Given the common parties, facts and issues, and potential overlapping interests present in these Applications, the Tribunal issued a Case Assessment Direction on June 20, 2012, directing the parties to indicate as to whether or not they consent to consolidation.
5Since the parties have confirmed that they consent to consolidation, these Applications are now consolidated and will proceed together. A joint mediation is scheduled for these Applications on August 20, 2012.
