Human Rights Tribunal of Ontario
B E T W E E N:
Carolyn Lynch Applicant
-and-
Producto Diemakers Inc. Respondent
DECISION
Adjudicator: David Muir Date: July 12, 2012 Citation: 2012 HRTO 1376 Indexed as: Lynch v. Producto Diemakers Inc.
1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of disability.
2On May 31, 2012 the Tribunal issued a Notice of Intent to Dismiss (NOID) to the applicant because it appeared that this Application may be outside of the jurisdiction of the Tribunal due to delay in its being filed. The applicant has not responded to the NOID although the time for doing so has passed.
3In the NOID the applicant was advised that if she did not respond to the NOID the Application may be dismissed as abandoned. The NOID was sent to the applicant’s address in the Tribunal’s file and was not returned.
4It appears that the applicant may have abandoned the Application and accordingly it is dismissed for that reason.
Dated at Toronto, this 12th day of July, 2012.
