1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”).
2On June 14, 2012, the Tribunal issued a Case Assessment Direction (“CAD”) that alerted the applicant to the fact that she had failed to comply with the obligations under Rules 16 and 17 to deliver to every party and file with the Tribunal a witness list, witness statements, and copies of documents the party intends to rely upon no later than 45 days prior to the hearing. The CAD directed that the applicant immediately comply and indicated that if she did not comply within seven days, the Application may be dismissed as abandoned.
3On June 26, 2012, the Tribunal issued a second Case Assessment Direction ordering the applicant to notify the Tribunal in writing by Friday June 29, 2012 of her intentions with respect to the Application including if she intends to pursue the Application and attend the hearing on July 16 and 17, 2012. The CAD indicated that absent written notification of the same, the Application may be dismissed as abandoned.
4Both CAD’s were sent to the parties by email and mail.
5The applicant has not complied with either CAD, nor has she communicated with the Tribunal.
6The Application is dismissed as abandoned and the hearing is cancelled.
