1By way of Interim Decision 2011 HRTO 550, the Tribunal consolidated Application 2010-05429-I and Application 2010-07219-I and deferred the Applications pending the conclusion of judicial review proceedings.

2On June 7, 2012, the applicant filed a request to reactivate the Application on the basis that the judicial review was completed in May 2011 and all levels of appeal were exhausted as of April 12, 2012, as a result of a judgement of the Supreme Court of Canada refusing to grant leave to appeal.

3The respondents did not file submissions in response to the applicant’s request to reactivate.

4Given that the judicial review process is completed, it appears that it is appropriate to reactive the Applications.

5Accordingly, the Applications are reactivated.
