1On consent of all parties, the Tribunal amends the order at paragraph [33] (2) and (3) of Martel v. Ontario (Community and Social Services), 2012 HRTO 735, as follows:
Within 60 days of the release of the decision of the Ontario Superior Court of Justice - Divisional Court on the application for judicial review of this Decision, if the respondent is unsuccessful on its application for judicial review, the respondent shall provide the complainants with retroactive and ongoing special diet allowance for chronic hepatitis C in accordance with the Code principles set out in this Decision.
Commencing within 60 days of the release of the decision of the Ontario Superior Court of Justice - Divisional Court on the application for judicial review of this Decision, if the respondent is unsuccessful on its application for judicial review, those responsible for administering the Ontario Disability Support Program and Ontario Works shall provide special diet benefits for individuals with chronic hepatitis C in accordance with the Code principles set out in this Decision.
