1On June 7, 2012, the Tribunal issued a Case Assessment Direction (“CAD”) that alerted the applicant to the fact that he had failed to comply with the obligations under Rules 16 and 17 to deliver to every other party and file with the Tribunal a witness list, witness statement, and copies of documents the party intends to rely upon no later than 45 days prior to the hearing. The CAD indicated that if the applicant failed to comply with these obligations within seven days of the date of the CAD, the Application may be dismissed as abandoned. The CAD was sent to the parties by e-mail.
2The applicant has not filed the documents and has not communicated with the Tribunal. The Application is dismissed as abandoned and the hearing is cancelled.
