1This Application was filed on August 15, 2011, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On April 18, 2012, the Tribunal sent the respondents’ Responses and notice of the respondents’ requests to dismiss to the applicant care of the address provided by the applicant to be used for contacting her. The letter required the applicant to file submissions in response to the requests for dismissal.
3On May 15, 2012, the Tribunal’s materials were returned to the Tribunal as undeliverable. Tribunal staff attempted to contact the applicant at the telephone number she had provided; however, it appears that the number was not in service as there was a constant busy signal. The applicant did not provide an email address or any other alternate contact information.
4On May 18, 2012, the Tribunal again wrote to the applicant and directed her to provide her new mailing address. The letter indicated that if the applicant failed to do so, the Application would be deemed as abandoned and the file closed.
5The Tribunal’s May 18, 2012 letter was not returned to the Tribunal. However, as of the date of this Decision, the applicant has not corresponded or communicated with the Tribunal nor provided any up to date contact information.
6Pursuant to Rule 1.13 of the Tribunal’s Rules of Procedure, all parties are required to notify the Tribunal and other parties of any change in contact information. Further, Rule 5.4 of the Tribunal’s Rules of Procedure states that Tribunal may finally determine an Application without further notice to any person who cannot be contacted by the Tribunal according to the contact information provided to the Tribunal by that person.
7The applicant has not provided the Tribunal with her current address or telephone number and has failed to respond to the Tribunal’s correspondence.
8In the circumstances, the applicant is deemed to have abandoned the Application.
9Accordingly, the Application is dismissed as abandoned.
