1This is an Application filed under s. 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2By Case Assessment Direction dated April 12, 2012, the Tribunal directed that a teleconference summary hearing would be held. In a Notice of Summary Hearing dated April 13, 2012, sent to the parties by regular mail at their addresses on file with the Tribunal, the summary hearing was scheduled to take place on June 11, 2012 at 9:30 AM. The Notice of Summary Hearing listed various possible consequences of a failure to attend the hearing, including that the Application may be dismissed as abandoned if the applicant failed to attend.
3The applicant failed to dial in to the teleconference at the scheduled time although counsel for the respondent did so. The Tribunal waited half an hour, as is its customary practice, but the applicant did not attend. In view of the applicant’s failure to attend the hearing, despite having received proper notice, the Application is dismissed as abandoned.
