[1] The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on August 3, 2010.
[2] On January 4, 2011 the Tribunal issued a Notice of Mediation to the parties confirming that mediation of the Application would take place on February 23, 2011 at 655 Bay Street, 14th Floor, Toronto, Ontario. The mediation date was cancelled at the request of the applicant.
[3] On March 24, 2011 the Tribunal wrote the applicant confirming a conversation earlier that day with the Tribunal’s scheduling department, in which the applicant indicated he wished to withdraw the Application. The letter enclosed a Form 9 (Request to Withdraw) and Form 23 (Statement of Delivery) with direction to complete and return the forms. The letter warned the applicant that a failure to respond to the letter in writing April 5, 2011 would be deemed an abandonment of the Application.
[4] As of the date of this Decision the applicant has not responded to the Tribunal and the Tribunal’s correspondence to him/her has not been returned.
[5] In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
