1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”), on November 1, 2010 alleging discrimination on the grounds of race, colour, ancestry and ethnic origin in employment. The Application has not yet been sent to the respondent for Response.
2On November 30, 2010, the Tribunal issued a Notice of Intent to Dismiss (“NOID”) to the applicant stating that it appeared the Application was outside the Tribunal’s jurisdiction because the narrative setting out the incidents of alleged discrimination failed to identify any specific acts of discrimination within the meaning of the Code and that the Application was filed more than one year after the last incident of alleged discrimination contrary to section 34(1) of the Code. The Tribunal requested that the applicant provide written submissions addressing this issue within thirty days and the applicant was warned that if she did not file written submissions within that timeframe, the Tribunal would make its decision based only on the information in her Application or may consider the failure to respond as an abandonment of her application and dismiss the Application for that reason.
3The applicant has not provided any submissions or otherwise responded to the NOID and the time for doing so has elapsed.
4In the circumstances, the Tribunal deems the Application abandoned and it is accordingly dismissed.
