1By way of an earlier Interim Decision, 2010 HRTO 2472, the Tribunal determined that it was uncertain whether Howard Kravitz, named in the Application as an individual respondent, had received notice of the Application.
2The Tribunal ordered that if the applicant wished to proceed with the Application including Howard Kravitz as an individual respondent, she was required to make efforts to ascertain an address or contact information at which Howard Kravitz could be provided with the Notice of Application. The Tribunal directed the applicant to provide, within 20 days of the date of that Interim Decision, a current and accurate address for Howard Kravitz and explain the steps taken to ensure that the address is current and accurate.
3To date, the applicant has not communicated or corresponded with the Tribunal regarding this matter and the timeline for doing so has elapsed. Consequently, it appears the applicant does not wish to proceed with the Application as against Howard Kravitz.
4As such, the Tribunal orders that the Application will proceed only against Nepean Rideau & Osgoode Community Resource Centre and the style of cause is amended accordingly.
5Given that the parties have confirmed a willingness to participate in mediation, the Application will be scheduled for mediation in the normal course.
6I am not seized of this matter.
