Decision
1This is an Application dated June 2, 2010 made under s. 45.9 (3) of the Ontario Human Rights Code, R.S.O. 1990, c.H-19, as amended (the "Code"). On April 18, 2011, the Tribunal sent a notice to the parties advising that a hearing by teleconference was scheduled for May 12, 2011 commencing at 1:30 pm and providing the call-in information needed by the parties to participate in the call.
2The applicant did not call in and was therefore not present at the hearing. The personal respondents and counsel for all respondents, attended on the call. In accordance with its usual practice, the Tribunal waited until 2:00 pm. At that time, the hearing was terminated.
3I am satisfied that the applicant had notice of the hearing. In addition to the April 18, 2011 Notice to the parties, the Tribunal issued a Case Assessment Direction to the parties in this matter. None of these documents sent to the applicant were returned to the Tribunal.
4In view of the applicant's non-attendance, the Application is hereby dismissed.
