1In a previous Interim Decision, (2011 HRTO 23), the Tribunal deferred this Application, which was filed on June 23, 2010, pending the resolution of a grievance before the Public Service Grievance Board (“PSGB”). On February 22, 2011, the applicant filed a Request for an Order to proceed under Rule 14.3, copied to the respondent, on the basis that the grievance has been withdrawn prior to a hearing on its merits, and that the PSGB file has been closed.
2The respondent has made no submissions, and the time for doing so has passed.
3In the circumstances, the Request to proceed is appropriate and is granted.
4There were two outstanding Requests for Order During Proceedings (“Requests”) in this matter at the time the Application was deferred. The respondents filed a Request to remove the individual respondent as a party to this proceeding. The applicant filed a Request to amend his Application to include the ground of reprisal. In the light of my decision to allow this Application to proceed, the parties are required to file whatever response they wish to make to these Requests within two weeks of the date of this Interim Decision.
5Both parties indicated that they are willing to undertake mediation in respect of the Application. Unless a party indicates within seven days of the date of this Interim Decision that he or she no longer wishes to take advantage of mediation, the Registrar will schedule a date for mediation.
6I am not seized of this matter.
