HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Ilemba Djangi
Applicant

Respondents
DECISION
Adjudicator: Ena Chadha
Indexed As: Djangi v. Coinamatic Canada
1This Application was filed on December 24, 2010 under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On April 4, 2011, the Tribunal issued a Notice of Intent to Dismiss (“Notice”) indicating that the Tribunal may not have jurisdiction over the Application because it appears that (1) the Application was filed more than one year after the last incident of discrimination and (2) the Application and the narrative setting out the incidents of alleged discrimination do not appear to identify any specific acts of discrimination within the meaning of the Code allegedly committed by the respondents.
3The Tribunal’s Notice indicated that the applicant was required to provide written submissions no later than May 4, 2011 addressing the jurisdictional issues identified in the Notice. The Tribunal’s Notice further indicated that, if the applicant did not file written submissions by the required time, the Tribunal may consider the failure to respond as an abandonment of the Application and dismiss the Application for that reason.
4The applicant has not responded to the Tribunal’s correspondence, nor filed submissions in accordance with the deadline.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6Accordingly, the Application is dismissed.
Dated at Toronto, this 12th day of May, 2011.
