1The complainant is deceased. On March 18, 2011, her representative advised the Tribunal that she was unable to obtain instructions as she was unaware of the whereabouts of anyone in a position to give instructions on behalf of the deceased or the Estate. She accordingly withdrew as representative.

2Following a Case Assessment Direction from the Tribunal, the Commission wrote to the next of kin of the complainant at the last known address asking that he contact the Commission respecting her Complaint by May 2, 2011. The Commission advises that the letter did not come back as undelivered. Attempts at reaching him by calling the number provided by the respondent were unsuccessful and there was no listing for him in Canada 411.

3In all the circumstances, the Complaint is dismissed as abandoned.
