HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Adrienne Delong Snow
Applicant
-and-
Lory James
Respondent
DECISION
Adjudicator: Kathleen Martin
Indexed as: Snow v. James
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the "Code"), on March 2, 2011.
2On March 16, 2011, the Tribunal issued a Notice of Intent to Dismiss (NOID) on the basis that the Application appeared to be outside the Tribunal's jurisdiction. The applicant was directed to provide written submissions responding to the issues raised in the NOID by April 15, 2011. The NOID advised the applicant that if he did not provide written submissions as directed, the Tribunal would make its decision based on the information in the Application or may consider the failure to respond as an abandonment of the Application and dismiss the Application for that reason.
3The applicant has not responded to the NOID and the time for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 6th day of May, 2011.
