DECISION
Adjudicator: Kathleen Martin
Indexed as: Sealy v. Go Transit
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on August 18, 2010.
2On March 11, 2011, the Tribunal issued a Notice of Intent to Dismiss (“NOID”) on the basis that the Application appeared to be outside the Tribunal’s jurisdiction. The applicant was directed to provide written submissions responding to the issues raised in the NOID within 30 days from March 11, 2011. The NOID advised the applicant that if she did not provide written submissions as directed, the Tribunal would make its decision based only on the information in the Application, or may consider the failure to respond as an abandonment of the Application and dismiss the Application for that reason.
3The applicant has not responded to the NOID and the time for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 6th day of May, 2011.
