1This is an Application filed on July 21, 2009, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”).
2The purpose of this Interim Decision is to address the applicant’s Request for Order During Proceedings filed by the applicant on March 30, 2011. The Request for Order seeks the re-activation of the Application and seeks to amend the monetary relief sought by the applicant. No response to the Request has been received from the respondents.
3By Interim Decision dated September 24, 2010 the Tribunal ordered the deferral of the Application until the conclusion of the criminal proceeding against the personal respondent.
4Having regard to the Request for Order filed by the applicant and the Probation and Conditional Sentence Orders filed by the applicant with the Request for Order, I am satisfied that that the sentence has been issued in the criminal proceedings have been completed. In these circumstances, the Tribunal will re-activate the Application.
5The applicant requests that her damages claim of $10,000.00 for the injury to her dignity feelings and self-respect be amended to $25,000.00.
6I can see no reason to deny the Request. It is early in the Tribunal process. There are no new allegations.
7The amendment is made without any determination by the Tribunal as to the appropriateness of the remedy, and without prejudice to any position the respondents may wish to take on the remedy sought.
8The Application is amended accordingly.
9I am not seized.
