1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on January 21, 2011, alleging discrimination with respect to employment. The allegations arise out of the applicant’s application for employment with New Democratic Party caucus services for the Parliament of Canada.
2On March 16, 2011 the Tribunal issued a Case Assessment Direction (CAD) seeking submissions from the applicant as to why she believed that her Application was within the jurisdiction of the Tribunal as the respondent appeared to be an organization under federal jurisdiction. On reviewing the applicant’s submissions, the Tribunal issued a further CAD on March 24, 2011. The CAD directed the applicant to provide a copy of the job advertisement that is at issue in her Application and to explain the basis on which she states that the Application is not related to the federal jurisdiction.
3The applicant provided further submissions along with the job application poster. This poster confirms that the respondent is an organization within the federal parliamentary service. The job poster refers to duties involving the support of the leader and caucus of the New Democratic Party. It refers to assisting and training of Member of Parliament staff. The email address for the submission of applications is an email address of the Parliament of Canada (parl.gc.ca).
4The Code only applies to matters that fall within provincial, rather than federal, jurisdiction. The Tribunal does not have the jurisdiction (the power) to adjudicate disputes involving federal organizations. The NDP caucus services is clearly a federal organization.
5Accordingly, the Application is dismissed pursuant to Rule 13.1 of the Tribunal’s Rules of Procedure.
