1The applicant filed an Application under section 34 of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on March 11, 2010,alleging discrimination in the area of services, goods, and facilities on various Code grounds, and reprisal. The applicant alleges she was subjected to discriminatory treatment by the respondent security guard. The Application indicates that a civil court action was pending.
2The respondent filed a Response on October 28, 2010 denying the allegations of discrimination and reprisal and asking the Tribunal to either dismiss or defer the Application because there appeared to be a civil action pending.
3On October 29, 2010, the Tribunal issued a Notice of Intent to Dismiss or Defer on the grounds that there is an on-going court proceeding arising out of the same facts of the Application.
4The applicant responded to the Notice of Intent to Dismiss or Defer on November 15, 2010 and indicated that there are no on-going court proceedings with respect to the facts as alleged in the Application.
5As such, there are no grounds, pursuant to section 34(11) or otherwise, upon which to dismiss or defer the Application.
6I am not seized of this matter.
