1This Application was filed October 9, 2009 pursuant to s. 34 of the Human Rights Code, R.S.O. 1990, c. H. 19, as amended (the "Code").
2Counsel for the applicant is requesting an adjournment of the hearing which is scheduled for May 16 and 17, 2011. He advises that he must travel abroad to tend to his ailing mother and does not anticipate returning until after the scheduled hearing dates. The respondents have no objection to an adjournment.
3Adjournment requests are not granted automatically and will only be allowed in extraordinary circumstances. Counsel for the applicant cites exigent personal circumstances. A medical emergency involving a close family member is an exceptional circumstance. The adjournment request is granted.
4The Registrar will re-schedule the two-day hearing for as early as possible following Counsel's return to Canada. The parties are directed to provide their available dates for the hearing between May 17 and July 15, 2011 in writing to each other and to the Registrar within five days of the date of this Interim Decision.
5I am not seized of this matter.
