1This Application was filed under s. 53(5) of Part VI of the Human Rights Code, R.S.O. 1990, c.H-19, as amended (the “Code”) with respect to the applicant’s original complaint made to the Ontario Human Rights Commission on July 4, 2007. The applicant alleges discrimination in employment on the basis of disability due to chronic back problems.
2By Interim Decision dated October 19, 2010, 2010 HRTO 2106, the Tribunal denied the applicant’s request that he be entitled to attend the hearing by teleconference, as there are serious credibility issues to be determined in this proceeding such that it would not be appropriate to allow the applicant to participate in this hearing by teleconference.
3In that Interim Decision, the applicant was directed to confirm within 20 calendar days that he was prepared to attend the hearing in this matter in person, failing which this Application would be dismissed as abandoned.
4It is now well over the time period afforded to the applicant to confirm his attendance at the hearing in this matter, and he has failed to do so.
5Accordingly, this Application is dismissed as abandoned. No hearing date has yet been scheduled in this matter.
