1This is an Application under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"). The applicant alleges discrimination in employment on the grounds of disability.
2In the Response filed on behalf of the Ontario New Democratic Party and Rosario Marchese, the respondents advised that there was a grievance procedure related to the events giving rise to the Application, and asked the Tribunal to defer further consideration of the Application until that process was completed.
3The applicant filed a Reply in which she advised that she has withdrawn the grievance. She included a letter dated February 15, 2011, addressed to the union respondent, stating that she does not wish to pursue the grievance.
4The applicant has withdrawn the grievance and there is accordingly no basis to defer the Application because of a grievance proceeding. The Tribunal will continue to process the Application.
5I am not seized of this matter.
