Adjudicator: Alan G. Smith
Date: April 20, 2011
Citation: 2011 HRTO 796
Indexed as: Brophy v. O.P.P. Professional Standards Bureau
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on January 12, 2011.
2The applicant was sent a Notice of Intent to Dismiss by the Registrar on March 10, 2011, which advised the applicant that it appeared the Application was outside the Tribunal’s jurisdiction (power to decide) because the Application failed to identify any specific acts of discrimination within the meaning of the Code allegedly committed by the respondent.
3The correspondence of March 10, 2011, further advised the applicant that she must file submissions responding to the issues identified by the Registrar by April 11, 2011, or the Application would be dismissed for lack of jurisdiction or considered abandoned.
4The applicant has not responded to the Tribunal’s correspondence.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
Dated at Toronto, this 20^th^ day of April, 2011.
