1This Application was deferred by way of Interim Decision, 2010 HRTO 1980, pending the completion of the applicant’s workplace grievance. On December 17, 2010, the applicant filed a Request to reactivate his Application indicating that his grievance was withdrawn.
2The respondents indicated that they have no objection to proceeding with the Application; however, the respondents sought written confirmation that the grievance was in fact withdrawn. By way of Case Assessment Direction dated April 6, 2011, the Tribunal directed the applicant to provide confirmation from his union that his grievance was withdrawn or concluded.
3On April 11, 2011, the Grievance Department of the applicant’s union wrote to the Tribunal, copied to the respondents, confirming that the applicant’s grievance was withdrawn on December 16, 2010. This completed the grievance process and there are no other outstanding grievances with respect to the applicant in the system.
4Given that the parties have indicated that they are amenable to participating in mediation, the Registrar’s Office will schedule a mediation in this matter in the normal course.
