HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Zvonimir Basic
Applicant
-and-
Royal Health Care Centre and Andy Gidwani
Respondents
INTERIM DECISION
Adjudicator: Sherry Liang
Date: April 19, 2011
Citation: 2011 HRTO 764
Indexed as: Basic v. Royal Health Care Centre
1This is an Application filed on August 31, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”).
2By email correspondence dated March 31, 2011, the applicant requests that I “remove [myself] from any involvement/decision rendering etc.” on the Application. He also requests that “ALL orders ever made by Adjudicator/Vice Chair: Sherry Liang between August 31, 2009 to present be revoked and reviewed by a new vice chair.”
3Although the requests have not been made on the Tribunal’s forms for a Request for an Order During Proceedings or a Request for Reconsideration, I will nonetheless address the applicant’s submissions.
4The reason given for both requests is that I have shown “great bias” in that I have always made rulings in the respondents’ favour.
5The applicant has not established any basis for the requests sought. He clearly strenuously objects to the prior Interim Decisions I have made on the Application but his disagreement alone does not support the request that I refrain from any further dealings with the Application. Whether or not, as asserted, I have “always” ruled in the respondents’ favour, the disposition of prior issues in one parties’ favour does not give rise to any reasonable apprehension of bias.
6The applicant’s submissions also provide no basis for reconsideration of the prior Interim Decisions.
7The applicant’s requests are denied.
8I am not seized of this matter.
Dated at Toronto this 19th day of April, 2011.
“Signed By”
Sherry Liang
