Running Room Canada Inc.
Respondent
DECISION
Adjudicator: Alan G. Smith
Indexed as: Fry v. Running Room Canada
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on January 24, 2011.
2The applicant was sent a Notice of Intent to Dismiss by the Registrar on February 25, 2011, which indicated that it appeared the Application was outside the Tribunal’s jurisdiction (power to decide) because the Application failed to identify any specific acts of discrimination within the meaning of the Code allegedly committed by the respondent.
3The correspondence of February 25, 2011 further advised the applicant that she must file submissions responding to the issues identified by the Registrar by March 28, 2011 or the Application would be dismissed for lack of jurisdiction or considered abandoned.
4The applicant has not responded to the Tribunal’s correspondence.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
Dated at Toronto, this 18^th^ day of April, 2011.
