HUMAN RIGHTS TRIBUNAL OF ONTARIO

James McNeil
Applicant

Great Northern Insulation Management Group Incorporated, Eric Brett and Stephen Purcell
Respondents
INTERIM DECISION
Adjudicator: Lorne Slotnick Date: April 18, 2011 Citation: 2011 HRTO 740 Indexed as: McNeil v. Great Northern Insulation
1By Notice dated February 2, 2011, the Tribunal advised the parties of a hearing date of June 1, 2011, for this Application.
2One of the personal respondents, Stephen Purcell, has written to the Tribunal requesting the matter be rescheduled. His letter is dated March 3, 2011, and does not appear to have been copied to any of the other parties.
3The Tribunal attempted to notify the applicant but has had difficulty contacting him. The applicant is requested to update his contact information with the Tribunal.
4Mr. Purcell’s Request says only that “I have a previous meeting scheduled for the same day and cannot change the date.”
5The Tribunal’s Practice Direction on Scheduling of Hearings and Mediations, Rescheduling Requests, and Requests for Adjournments provides that rescheduling requests must be made within 14 days of the Tribunal’s notice of hearing, and that adjournments will only be granted in “extraordinary circumstances.”
6Mr. Purcell has made his Request well outside the 14-day period, and has not cited any extraordinary circumstances that would lead the Tribunal to adjourn the hearing.
7Therefore, the Request by the respondent Stephen Purcell to reschedule the hearing is denied.
Dated at Toronto, this 18th day of April, 2011.
