1This is an Application filed on December 17, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code").

2On November 19, 2010, the Application went to mediation. At that time, the applicant advised that he did not wish to proceed with his Application, but declined to complete a Request to Withdraw (Form 9).

3On December 10, 2010, the Tribunal wrote to the applicant confirming the information set out in paragraph 2 above and directing that the applicant immediately advise the Tribunal in writing of his intentions with respect to the Application. The Tribunal concluded as follows:

If the applicant does not respond to this letter by December 20, 2010 to advise that he wishes to withdraw or proceed with the Application, the HRTO will deem the Application abandoned and close the file.

4The letter was sent by regular mail to the applicant at the address provided by the applicant in the Application.

5The Tribunal has not received any response to its letter and the time period for responding has elapsed.

6Having regard to the above I find that Application is abandoned. The Application is dismissed.
