1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on September 15, 2010 alleging discrimination in employment on the basis of record of offences. The Tribunal issued a Notice of Intent to Dismiss (“Notice”) on October 25, 2010 advising the applicant that her Application appeared to outside the Tribunal’s jurisdiction. Specifically, the applicant denied that she had been discriminated against on the basis of either a federal or provincial offence.
2The applicant was advised that if she did not respond within 30 days of the date of the Notice, the Tribunal might deem the Application abandoned and the close its file. The applicant has not responded to the Tribunal’s correspondence and the time to do so has passed.
3In the circumstances, the applicant is deemed to have abandoned the Application.
4The Application is dismissed.
