1These Applications were filed August 5, 2009 and November 9, 2009 pursuant to s. 34 of the Human Rights Code, R.S.O. 1990, c. H. 19 as amended (the “Code”), and are to be heard together.
2Counsel for the applicant is requesting an adjournment of the hearing which is scheduled for May 12, 2011. He advises that he must travel abroad to tend to his ill mother and does not anticipate returning until May 15, 2011.
3Adjournment requests are not granted automatically and will only be allowed in extraordinary circumstances. Counsel for the applicant cites exigent personal circumstances. A medical emergency involving a close family member is an exceptional circumstance. The adjournment Request is granted.
4The Registrar shall re-schedule the one-day hearing for as early as possible following Counsel’s return to Canada. The parties are directed to provide their available dates for the hearing between May 17 and July 15, 2011 in writing to each other and to the Registrar within five days of the date of this Interim Decision.
