DECISION
Adjudicator: Alan G. Smith
Indexed as: Fitzpatrick v. Children’s Aid Society of the Three United Counties of Stormont, Dundas and Glengarry
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on January 17, 2011.
2The applicant was sent a Notice of Intent to Dismiss by the Registrar on February 17, 2011, which advised the applicant that it appeared the Application was outside the Tribunal’s jurisdiction on the following basis:
a) The Application failed to identify any specific acts of discrimination within the meaning of the Code allegedly committed by the respondent;
b) The Application alleges incidents of discrimination which occurred more than one year before the Application was filed.
3The correspondence of February 17, 2011 further advised the applicant that she must file submissions responding to the issues identified by the Registrar by March 18, 2011 or the Application would be dismissed for lack of jurisdiction or considered abandoned.
4The applicant has not responded to the Tribunal’s correspondence.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
Dated at Toronto, this 5th day of April, 2011.
