1On March 4, 2011, I issued a Decision in which I found that the applicant had abandoned the Application and therefore the Application was dismissed. This Decision was based on information that the applicant had not attended a scheduled mediation, had not communicated with the Tribunal to explain his failure to attend, and had not responded to the Tribunal’s letter of February 3, 2011 seeking confirmation of his intentions regarding the Application. It is now apparent that the applicant did communicate with the Tribunal on January 13, 2011, indicating that he had missed the mediation and wanted direction as to what he needed to do. Unfortunately the applicant’s email of January 13, 2011was inadvertently not placed in the file.
2The applicant has filed a Request for Reconsideration stating that he did not receive the Tribunal’s letter of February 3, 2011. I note that the Tribunal’s letter was mailed to the applicant. The Application reflects that email is the best way to send information to the applicant.
3In the circumstances, I reconsider the Decision of March 4, 2011 and set aside the dismissal. The Application will continue to be processed. Unless the Tribunal hears otherwise, the parties will be contacted regarding the scheduling of an alternative date for mediation.
