1This is an Application filed June 3, 2009 under section 53(5) of Part VI of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2By Case Assessment Direction dated December 2, 2010 (“the CAD”), the Tribunal provided the following directions to the applicant:
The applicant is directed to advise the Tribunal if he wishes to continue this Application and if he does, against which respondents. If the applicant wishes to continue against the corporate respondent then he should provide submissions in response to Ms. Ramalho’s letter of April 16, 2010. If the applicant wishes to continue the Application against any of the individual respondents he shall ensure that the individual respondents are sent a copy of the Application and file a Form C confirming proof of service. The foregoing information shall be provided within 30 days of the date of this Case Assessment Direction.
3The Tribunal further stated that if it did not receive this information within 30 days, the Application may be dismissed.
4The Tribunal has not received the information directed to be provided pursuant to the CAD and the time period for providing it has elapsed.
5Having regard to the above, I find that the applicant has abandoned the Application. The Application is therefore dismissed.
