1This is an Application filed on June 29, 2009 pursuant to section 53(5) of the Ontario Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”). The applicant, in the human rights complaint underlying this Application alleges that her right to be free of discrimination and harassment in the workplace in respect of an alleged disability and sex has been infringed by the respondents.
2This Interim Decision deals with a Request for Order During Proceeding filed by the respondents on January 27, 2011, seeking the dismissal of the Application on the basis, that the applicant had failed to comply with two earlier directions of the Tribunal: first, the applicant failed to file full particulars of the remaining allegations set out in paragraph 14(a) of Interim Decision 2010 HRTO 2409 dated December 3, 2010; and, second, the applicant further failed to comply with this direction within 10 days of the date of the letter from the Registrar-Transition setting out a hearing date of April 21, 2011.
3The applicant appears to have addressed the Request by filing particulars of the remaining allegations on January 31, 2011.
4The Request is denied at this stage, the consequence if any of the applicant’s late filing of particulars may be dealt with at the hearing.
