1This Interim Decision addresses the applicant’s Request for an Order During Proceedings (Form 10) asking that the Tribunal order the respondent to provide the corporate name of the U-shaped Gateway Newsstands store at the Fairview mall. The applicant indicates that she wishes to add the owner of this store as a respondent to her Application.
2The applicant notes in both her Application and her Form 10 that attempts had been made to get this information from corporate searches, but that these searches revealed two numbered companies in two units at the mall.
3The respondent indicated in its Response that it would not provide this information unless ordered to do so by the Tribunal. The respondent has not filed a Form 11 in response to the Request for Order and the time for doing so has now passed.
4Under Rule 1.7(p) of the Tribunal’s Rules of Procedure, the Tribunal may require a party to produce information in order to provide for the fair, just and expeditious resolution of a matter before it. To enable the applicant to name as a respondent the owner of the store identified in the narrative of the Application, I order the respondent to provide the applicant and the Tribunal the correct corporate name of the U-shaped Gateway Newsstands store located on the second floor of the Fairview Mall by January 14, 2011.
