1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on January 19, 2010. The respondent filed a Response on April 12, 2010.
2All parties consented to mediation of the Application. By Notice dated December 13, 2010, the Tribunal scheduled a mediation session on January 28, 2011. The mediation was rescheduled to February 15, 2011. The applicant was advised of the proposed February 15 date by email, in advance of the date being scheduled, and by Notice dated January 10, 2011 by mail.
3The applicant failed to attend the mediation and did not contact the Tribunal to seek an adjournment.
4By letter dated February 17, 2011, the Tribunal directed the applicant to advise of her intentions with respect to the Application. The letter went on to warn the applicant that if she did not respond within 10 days the Tribunal would deem the Application abandoned and close its file. This letter was returned to the Tribunal as “moved/unknown”.
5By email dated March 4, 2011 the Tribunal repeated its request to the applicant and advised that if she did not respond within five days the Tribunal would deem the Application abandoned. This email was sent to the applicant at the email address provided in the Application. The email was not returned.
6The applicant has not responded to the Tribunal’s correspondence, nor has she communicated with the Tribunal in any other manner.
7In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
