1This is an Application alleging discrimination in employment contrary to the Human Rights Code, R.S.O. 1990, c.H-19, as amended (the “Code”). A hearing was scheduled for March 10, 2011, commencing at 9:30 am at the Tribunal’s hearing centre in Toronto.
2The applicant was not present at the hearing. In accordance with its usual practice, the Tribunal waited until 10:00 am before proceeding. At the end of that time, the respondents asked the Tribunal to dismiss the Application as abandoned.
3I am satisfied that the applicant had notice of the hearing. A Confirmation of Hearing notice was sent to the applicant at the address he provided. The notice was not returned to the Tribunal as undeliverable.
4Counsel for the respondents advised that the documents that the respondents intended to rely on at the hearing were delivered to the applicant by courier on February 22, 2011 and there was no indication that they had not been received by the applicant.
5In view of the applicant’s non-attendance, the Application is dismissed as abandoned.
