INTERIM DECISION
Adjudicator: Naomi Overend Date: January 4, 2011 Citation: 2011 HRTO 5 Indexed as: Needham v. Northern Ontario School of Medicine
Decision
1This Interim Decision deals with the applicant’s Request for Order during Proceedings (Form 10) asking to amend her Application to add further particulars. Her Application, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleges that the respondents discriminated against her in the provision of educational services on the basis of disability, marital status, family status and age.
2The applicant, who at the relevant times was in an ongoing relationship with the organizational respondent, alleges that she experienced further discrimination subsequent to filing her original Application with the Tribunal on September 1, 2009. Her Form 10 contains an addendum with the additional particulars, which are alleged to have occurred during her January 2010 examinations
3The respondents have not filed a Response to the Request for Order (Form 11) or otherwise indicated that they oppose the applicant’s Request to amend.
4In light of the ongoing nature of the amendments, the timeliness of the request and the apparent absence of prejudice to the respondents, it would be appropriate to grant the applicant’s request to amend. Accordingly, this Application is amended to include the second addendum as attached to the applicant’s Form 10.
5I am not seized of this matter.
Dated at Toronto, this 4th day of January, 2011.
