1The applicant filed this Application on June 15, 2010, under section 34 of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The Application originally named an individual, Lou Cino, as the only respondent.
2Along with a Response, the respondent filed a Request for Order During Proceedings (“RFOP”). The RFOP requests that Lou Cino (“individual respondent”) be removed and, in substitution, the applicant’s and individual respondent’s employer, Pink Elephant Inc., be named as the corporate respondent. The respondent states that all allegations against the individual respondent fall within the scope of his employment with the Pink Elephant Inc. (“corporate respondent”).
3On December 23, 2010, the applicant filed a Response to the RFOP indicating that he consents to substitute the corporate respondent in lieu of the individual respondent. The applicant states that he agrees that the individual respondent was acting within the scope of his employment.
4On consent of the applicant, the individual respondent is removed and the corporate respondent is added to the Application. The style of cause is amended accordingly.
5Given the parties’ willingness to participate in mediation, the Registrar’s office will contact the parties to schedule a mediation in this matter.
