1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on May 29, 2009, the respondent filed a Response on July 30, 2009, and the applicant filed a Reply on August 28, 2009.
2On September 10, 2010, the Tribunal sent the parties a Notice of Mediation, which informed them that the Tribunal had scheduled a mediation of the Application for November 26, 2010.
3On November 24, 2010, counsel for the applicant wrote the Tribunal advising that she no longer represented the applicant. On November 25, 2010, the Tribunal attempted to contact the applicant to confirm that that she would attend the mediation; however, the Tribunal was unable to directly communicate with the applicant to confirm her attendance. The applicant did not attend at the mediation.
4The Tribunal made further attempts to contact the applicant by telephone and mail. On December 9, 2010, the Tribunal wrote to the applicant and advised the applicant that it is the responsibility of each party to provide the Tribunal with their current contact information. The Tribunal directed the applicant to confirm her contact information with the Tribunal by December 17, 2010 and state her intentions regarding the Application. The Tribunal further advised that if the applicant failed to respond by December 17, 2010, her Application may be dismissed as abandoned.
5To date, the applicant has failed to contact the Tribunal. In the circumstances, the applicant is deemed to have abandoned the Application. Accordingly, the Application is dismissed.
