DECISION
Adjudicator: Sherry Liang
Date: February 25, 2011
Citation: 2011 HRTO 417
Indexed as: Scharf v. Canadian Broadcasting Corporation
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on October 15, 2010.
2On January 18, 2011 the Tribunal issued a Notice of Intent to Dismiss the Application because it appeared to be outside the Tribunal’s jurisdiction to decide. The applicant was directed to provide written submissions in response to the Notice by February 17, 2011. The Notice went on to warn the applicant that the failure to provide a response to the Notice might be considered an abandonment of the Application and the application could be dismissed for that reason.
3As of the date of this Decision the applicant has not responded to Notice and the Tribunal’s correspondence to her has not been returned as undeliverable.
4In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
Dated at Toronto, this 25th day of February, 2011.
