1By way of Interim Decision, 2009 HRTO 178 dated February 19, 2009, the Tribunal deferred this Application pursuant to Rule 14 of its Rules of Procedure pending the completion of a proceeding under the Canadian Human Rights Act ("CHRA").

2On January 12, 2011, the Tribunal wrote to the applicant seeking information about the status of the CHRA proceeding. The Tribunal notified the applicant that, within 30 days, the applicant was required to advise the Tribunal whether the CHRA proceeding was still ongoing and, if possible, when it was expected to be completed. The Tribunal advised the applicant that if he failed to inform the Tribunal of the status of the other proceeding, the Tribunal may dismiss the Application as abandoned.

3As of the date of this Decision, the applicant has not advised the Tribunal of the status of the other proceeding. In the circumstances, the applicant is deemed to have abandoned the Application.

4Accordingly, the Application is dismissed.
