1Further to the conference call with the parties on February 23, 2011, ARCH’s Request to Intervene is unopposed and appropriate. ARCH is granted leave to intervene.
2The Tribunal confirms that Sheila Barber is not yet litigation guardian for Carrie Barber and the Tribunal will consider the applicant’s request for an order to that effect.
3In the circumstances of this case, the Tribunal directs as follows:
(1) The applicant will deliver to the other parties and file with the Tribunal an affidavit in support of Sheila Barber’s request to be appointed as litigation guardian for Carrie Barber by March 16, 2011.
(2) The respondent CCAC will deliver to the other parties and file with the Tribunal by April 13, 2011, submissions in support of its argument that Sheila Barber should not be appointed litigation guardian due to a conflict of interest.
(3) The Registrar will schedule a teleconference on April 26, 2011, at 9:30 AM to hear submissions on whether Ms. Barber should be appointed litigation guardian.
