1The applicant filed an Application under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”) on December 16, 2008. The respondent filed its Response on February 3, 2009. The Response contains a request that the Tribunal defer consideration of the Application pending the conclusion of a grievance and arbitration process.
2The applicant provided submissions on the Request for deferral on March 19, 2009.
3On March 26, 2009, the Application was deferred pending the conclusion of the applicant’s grievance arbitration proceeding: See 2009 HRTO 353.
4By correspondence dated October 26, 2010, the Registrar directed the applicant to advise the Tribunal of his intentions with respect to her Application. The applicant was further advised that if she did not respond within 30 days of the date of the correspondence, the Tribunal would deem the Application abandoned and the close its file. The applicant has not responded to the Tribunal’s correspondence.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
