1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on October 7, 2009, and the respondent filed a Response on February 5, 2010.
2Both parties indicated that they agreed to attend mediation. Mediation was scheduled for October 13, 2010 and a Notice was issued confirming the date, time and location. The applicant failed to appear on the scheduled date for mediation.
3By mail and email correspondence dated January 4, 2011, the Registrar directed the applicant to advise the Tribunal of her intentions with respect to her Application. The applicant was advised that if she did not respond within 10 days of the date of the correspondence, the Tribunal would deem the Application abandoned and close its file.
4Further email correspondence was sent by the Registrar on January 19, 2011, again directing the applicant to advise the Tribunal of her intentions with respect to the Application. The applicant was advised that if she did not respond by January 21, 2011, the Tribunal would deem the Application abandoned and close its file.
5The applicant has not responded to the Tribunal’s correspondence.
6In the circumstances, the applicant is deemed to have abandoned the Application.
7The Application is dismissed.
