1This is an Application filed on August 31, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”).
2The Tribunal has directed a Summary Hearing by conference call in this matter, originally scheduled for February 17, 2011.
3By Interim Decision dated February 1, 2011, 2011 HRTO 228, the Tribunal denied the applicant’s request to re-schedule the hearing, because it had not been made in a timely manner. This Vice-chair was unaware of an earlier, timely, request to reschedule the hearing made by the respondents. The Interim Decision of February 1, 2011 is accordingly revoked. The Tribunal will contact the parties about a new date for the hearing.
4Several outstanding Requests for Order have been held in abeyance pending the Summary Hearing. After further consideration, the Tribunal will deal with one Request as a preliminary matter at the Summary Hearing – the applicant’s Request to add two additional respondents. The proposed respondents have provided detailed submissions in response to this Request. The applicant should be prepared to address this Request at the Summary Hearing. He should address whether his allegations against the proposed respondents raise any claim of discrimination or any violation of Part I of the Code on their part and whether his allegations against them have any reasonable prospect of success.
5The Tribunal will send to the proposed respondents, for their information, the Application and the Case Assessment Direction of January 10, 2011. The proposed respondents will be contacted about the scheduling of a new hearing date.
