[1] By Case Assessment Direction dated November 1, 2010, the Tribunal directed that a Summary Hearing be held in this matter by teleconference. On December 9, 2010, a Notice of Summary Hearing was sent to the parties scheduling the teleconference for February 7, 2011, at 9:30 AM and providing the relevant call-in number. The Notice was sent by mail to the address provided by the applicant when he filed his Application. The Notice has not been returned.
[2] By 9:50 AM, twenty minutes after the scheduled hearing time, the applicant had failed to dial in to the conference call held this morning or otherwise attempt to contact the Tribunal to explain his failure to participate. The respondent was in attendance.
[3] Accordingly, in all the circumstances, the Application is dismissed as abandoned.
