DECISION
Adjudicator: Eric Whist
Indexed as: Owens v. Ontario (Health and Long-Term Care)
1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On September 25, 2009, the applicant filed a Request for an Order During Proceedings (“RFOP”) asking the Tribunal to adjourn the processing of the Application for six months in light of initiatives being undertaken by the respondent. The RFOP states that the applicant would continue with the Application after the six-month adjournment, if necessary.
3On October 20, 2009, the respondent filed a Response consenting to the RFOP.
4On November 16, 2009, the Tribunal adjourned the Application on the condition that if no party asked that it proceed by November 16, 2010, that the Application might be dismissed as abandoned.
5As the Tribunal has not had any requests from the parties to proceed with the Application, it is dismissed as abandoned and the Tribunal will close its file.
Signed at Toronto, this 2nd day of February, 2011.
